Terms of Service

Welcome to ChromaMuse. These Terms of Service ("Terms") govern your use of the ChromaMuse mobile application (the "App") provided by ChromaMuse ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years old (or the applicable age of digital consent in your jurisdiction) and agree to comply with these Terms. If you do not agree, please do not use the App.

2. Description of Service

ChromaMuse is an AI-powered personal color analysis and styling application that:

• Analyzes your personal coloring from a selfie to determine your seasonal color type and personalized palette.
• Generates AI-created outfit and makeup look suggestions based on your color palette.
• Provides outfit color scoring and styling recommendations.
• Offers a digital closet to save and organize generated looks.

3. User Accounts and Data

The App does not require you to create an account with a username or password. Your data (color analysis results, generated content, and preferences) is associated with your device and your App Store purchase history.

4. Subscriptions and Purchases

4.1 Subscription Plans

The App offers the following subscription options:

• Weekly Plan: $4.99 per week, includes 12 styling credits that reset weekly.
• Annual Plan: $39.99 per year, includes 95 styling credits available immediately.

4.2 Styling Credits

Styling credits are consumed when generating AI content. Credit usage varies by feature (e.g., outfit generation uses 4 credits, makeup generation uses 2 credits). Additional credit packs may be purchased separately and do not expire.

4.3 Payment and Billing

• All purchases are processed through the Apple App Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your App Store account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your App Store account settings.

4.4 Refunds

Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload images that you do not have the right to use or that contain inappropriate, offensive, or illegal content.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Use the App to generate content that infringes on the intellectual property rights of others.
• Use automated systems (bots, scrapers) to access the App.
• Share, resell, or redistribute your subscription or credits to others.

6. Intellectual Property

6.1 Our Content

The App, including its design, features, code, graphics, and branding, is owned by ChromaMuse and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without our express permission.

6.2 Your Content

You retain ownership of photos you upload to the App. By uploading a photo, you grant us a limited, temporary license to process it solely for the purpose of providing the color analysis service. This license terminates when the photo is deleted after processing.

6.3 Generated Content

AI-generated outfit and makeup images created through the App are provided for your personal, non-commercial use. You may save, share, and use these generated images for personal purposes (e.g., social media, personal reference). Commercial use of generated content requires our prior written consent.

7. AI-Generated Content Disclaimer

The App uses artificial intelligence to generate color analysis results, outfit suggestions, and makeup looks. You acknowledge that:

• AI-generated results are suggestions and should not be considered professional styling, beauty, or medical advice.
• Color analysis results may vary based on photo quality, lighting conditions, and other factors.
• Generated outfit and makeup images are artistic interpretations and may not exactly represent real products or looks.
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• In no event shall ChromaMuse be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claim arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ChromaMuse, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, if you violate these Terms. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ChromaMuse operates, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration association in our jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChromaMuse regarding the App and supersede all prior agreements and understandings.
